Terms and Conditions and Terms of Use

Last updated:

These Terms and Conditions and Terms of Use (the "Terms") apply to the use of the website, the app and the magazine service of Postamory between Postamory, Heidelberg ("we") and you as the customer. Please read them together with the Privacy policy and the Withdrawal information.

1. Scope and contracting parties

These Terms apply to all contracts about Postamory between us and consumers (section 13 of the German Civil Code, BGB) and, where expressly stated, traders (section 14 BGB). A consumer is any natural person who concludes the contract for purposes that are predominantly outside their trade, business or profession.

The contracting party is the person who completes the order. Other members of the family use the service but are not themselves contracting parties; section 5 applies to them. Conflicting or deviating terms of the customer do not apply unless we expressly agree to them in text form.

2. Contract formation

The presentation of the plans on the website is not a binding offer but an invitation to you to make an offer. The contract is formed as follows:

  1. You choose a plan and a billing interval, set up your family and enter the details of the magazine's recipient.
  2. In the payment summary you check all details (plan, price, number of magazines, charge dates, delivery address). You can correct input errors there before ordering by using "Edit details".
  3. By clicking the button "Pay and subscribe" you make a binding offer to conclude the contract. Beforehand you confirm these Terms and take note of the withdrawal information.
  4. We confirm receipt of your order by e-mail. The contract is formed when we accept your offer, by our confirmation e-mail or by activating your subscription, at the latest when the first payment is received.

The contract languages are German, English and Turkish. We store the order data; you receive it and these Terms with the confirmation e-mail, and you can view and save the Terms at any time on this page. We may refuse orders for a justified reason, for example incomplete or incorrect details or suspected misuse.

3. Our services

With Postamory a family shares photos and short texts during the month and receives a printed family magazine by post. We owe:

  • the provision of the shared family space (website and app) to add and view posts, to the extent of the plan you booked;
  • the layout of one magazine per issue from the posts submitted by the end of the submission period, and its printing and shipping, as often as your plan includes issues;
  • optional features such as the newspaper-style writing help. It only makes suggestions; you are responsible for the final text.

The plan, page count, format and scope of services as shown before the order are decisive. Layout and design follow our templates; we do not owe a particular design result. We may use and change printing and delivery partners and technical service providers (currently Supabase, Vercel, Stripe, Resend and Cloudflare); details are in the privacy policy.

4. Your account

  • To have an account you must be at least 18 years old and have legal capacity.
  • Give correct details and keep your password secret. You are responsible for activity under your account unless you could not have prevented misuse.
  • A person can belong to only one family at a time.
  • Tell us at i116@pm.me if you suspect that someone else has access to your account.
  • We send important notices (confirmations, payment, price and cancellation notices) to the e-mail address of your account; keep it up to date and reachable.

5. Families and equal rights of all members

A family is a shared space. All members of a family have equal rights; there is no owner and there are no ordinary members. In particular, every member can:

  • invite new members and create invitation links;
  • remove other members from the family;
  • edit the family details, including the recipient and the delivery address;
  • manage the subscription, including changing, cancelling or continuing it, and see the payment status;
  • react to every post in the family with emoji.

Every member can edit or delete only their own posts. No member, including the person who created the family, can change or delete a post written by another member; the other members can only react to it with emoji.

So invite only people you trust: members can remove other members and cancel the subscription. We cannot decide disputes between members, we do not check the members' entitlements among themselves and we act on the instruction of any member. You bear the risk of actions by the members you invited. One exception: the Stripe payment portal (change the payment method, view invoices) can be opened only by the person who paid last, because it shows that person's payment method. Anyone who is removed or leaves loses access to the family; content they published remains part of the family's content.

6. Your content

All rights in the photos and texts you upload stay with you. You grant us a non-exclusive, worldwide right, limited to the duration of the contract and of storage, to store, copy and technically process your content (in particular to resize it), to show it to the members of your family, to lay it out, to print and deliver it in the family magazine and, for that purpose, to pass it on to our printing and delivery partners. The right ends when the content is deleted, but not for copies already printed and for copies we are legally required to keep or need to defend legal claims.

You are responsible for your content. You warrant that you are entitled to share and print it, that it does not infringe the rights of third parties (copyright, personality, trademark or data protection rights) and that you have obtained the necessary consent of the people shown or named, for children and young people that of their parents or guardians. You indemnify us against claims of third parties based on a breach of these duties for which you are responsible, including reasonable costs of legal defence; statutory rights remain unaffected.

We do not review content in advance. You can report unlawful content or content that breaches these Terms at any time to i116@pm.me, ideally stating the content and a reason. We review reports promptly and may remove or block content or exclude it from printing; where reasonable, we inform those concerned and state the reason.

7. Prohibited use

You must not upload or share content that

  • is unlawful or shows or promotes violence, sexual exploitation or abuse, in particular of children;
  • contains nudity or sexually explicit material;
  • is hateful, harassing, abusive or threatening, or infringes the privacy or rights of others, including copyright;
  • contains malware or is meant to disrupt or overload the service.

You must not misuse the service, for example through automated access, attempts to bypass security or access limits, or by using the invitation feature for spam. Because the magazine is printed and posted, we may refuse, remove or not print content that in our judgement breaks these rules or the law. We may report unlawful content to the authorities.

8. Free use

Without a subscription you can try the service free of charge with up to 10 uploads (posts) in total per family. Deleting a post does not free up a slot. The limit is shown in the app; after that you need a subscription to add more content. Free use is a voluntary offer with no right to its continuation: we may change its scope and limit or end the offer for the future. For existing free families we announce this at least 30 days ahead.

9. Plans, prices and billing

Postamory is offered as a subscription in the plans Mini, Classic and Premium, billed in advance monthly, every three months, every six months or yearly. The longer periods (3, 6 and 12 months) are offered at a lower monthly-equivalent rate: pages and the payment summary may show the rate per month, while the amount charged is the total for the billing period you choose (number of months × monthly-equivalent rate, for example the sum of three months for the three-month plan). We show you the plan, price, number of included magazines, billing period and charge dates in the payment summary before you order.

  • All prices are final prices. In accordance with section 19 of the German VAT Act (UStG), no VAT is charged.
  • Shipping of the magazine is included in the price.
  • The first payment is due with the order. Monthly subscriptions are then charged on the 25th of a month for the following billing period; three-monthly, six-monthly and yearly subscriptions on the renewal date stated in the payment summary and in the order confirmation, also on the 25th of a month.
  • We inform you by e-mail before every charge (5 days before for monthly, 7 days for 3-month, and 14 days for 6-month and yearly subscriptions). The notice is a service; the charge happens as agreed even without it.
  • After the billing period ends, the subscription renews automatically for the same period unless it is cancelled under section 12: a three-month subscription for a further three months, a six-month subscription for a further six months, a yearly subscription for a further year. Cancellation takes effect at the end of the paid period.
  • The price shown when the contract is concluded, including a pre-registration price, applies to your subscription for as long as it continues without a break, subject to section 11.

10. Payment and late payment

  • Payment is made through our payment provider Stripe with the payment methods offered there (currently card payment). You enter payment details at Stripe; they do not reach our servers. With the order you authorise us to collect amounts when due on the agreed dates using the stored payment method.
  • You make sure there are sufficient funds and your payment details are up to date. If a failed or reversed payment for which you are responsible causes us costs, you may have to reimburse them in the proven amount; you remain free to prove that no damage or substantially lower damage occurred.
  • If a payment fails, Stripe may try it again several times. We inform you by e-mail and ask you to update your payment method.
  • If a payment remains open despite a payment request with a reasonable period of at least 7 days, we may suspend access to the subscription and further services and terminate the contract for good cause under section 13. Statutory claims for default remain unaffected.
  • You may set off against our claims only with claims that are undisputed or finally established by a court.

11. Price changes

If our costs of providing the service demonstrably change (in particular for printing, paper, postage and delivery, payment processing or hosting), we may adjust the prices of existing subscriptions for future billing periods to the extent of the cost change. If costs fall, we pass that on in the same way.

We notify you of a price change by e-mail at least 30 days before it takes effect and point out your right to cancel. For billing periods already paid, the previous price stays unchanged. You can cancel the subscription until the change takes effect; it then ends at the end of the current, already paid billing period, and the price change does not apply to you. If you do not cancel, the new price applies from the next billing period.

12. Cancellation by you

  • You can cancel the subscription at any time. The cancellation takes effect at the end of the current, already paid billing period. Until then the subscription continues, and magazines already paid for are produced and shipped. After that nothing more is charged. We do not refund already paid periods pro rata on cancellation, because the period is paid and we provide the service for it; your statutory rights, in particular for renewal periods under this section, remain unaffected.
  • You can cancel in the app under the subscription settings, without logging in through the cancellation function, or in text form to i116@pm.me. To protect against misuse by third parties, a cancellation made through the cancellation function is confirmed by a link that we send to the e-mail address entered: it takes effect once you confirm it, the time of your declaration, that is the time you submitted the form, is decisive once it is confirmed, and a cancellation that is not confirmed within seven days has no effect. We confirm receipt of the cancellation by e-mail with the date, time and the point at which the contract ends. A cancelled subscription can be continued before the period ends.
  • If the subscription has renewed after the first billing period (a three, six or twelve-month period), you can cancel it as a consumer with one month's notice. We then refund pro rata the fees already paid for the time after the contract ends, on notification at i116@pm.me.
  • The right to terminate for good cause (section 314 BGB) remains unaffected.
  • After the subscription ends, the family behaves as in the free offer under section 8: existing posts stay stored, new posts are possible only within the limit.
  • Withdrawal and cancellation are different: withdrawal is a statutory right within 14 days after the contract is concluded and is governed by the Withdrawal information; cancellation ends the subscription for the future.

13. Suspension and termination by us

Termination for good cause: We may terminate the contract for good cause (section 314 BGB) without notice if, taking all circumstances and both parties' interests into account, we cannot reasonably be expected to continue until the end of the billing period. Good cause exists in particular in the case of:

  • a significant breach of these Terms, or one repeated despite a warning, in particular of section 7;
  • unlawful or abusive content or use of the service, including to the detriment of third parties;
  • fraud, unjustified chargebacks or refusal to pay;
  • default in payment despite a payment request with a deadline under section 10;
  • a danger to the security, integrity or availability of the service or to other users.

On termination for good cause we do not refund fees for the current billing period to the extent you are responsible for the reason and the law does not provide otherwise. If we terminated for good cause for which you are not responsible, we refund pro rata the fees for the time after the termination. If the reason concerns only one member, we may limit ourselves to suspending or removing that member.

Ordinary termination: We may also terminate the contract without good cause with 30 days' notice in text form. If the contract thereby ends before an already paid billing period has expired, we refund pro rata the fees already paid for the time after the termination takes effect. We still complete and deliver magazines whose production had already begun when the termination takes effect.

Suspension: If there is a justified suspicion of a breach of section 7 or of a security risk, we may temporarily block content, access or the account for as long as is necessary for the review. We will usually inform you and state the reason, and give you an opportunity to comment where reasonable. If the suspicion proves unfounded, we lift the suspension.

Consequences of the end: After the end you can no longer use the family space. So secure your originals in good time. You can ask for a copy of your data at i116@pm.me within 30 days after the end. Deletion follows the privacy policy. Rights and obligations that arose before the end remain.

14. Extra pages

Each plan includes a set number of pages per magazine. A family can buy additional pages in steps up to the maximum shown in the app. The price and the amount due immediately are shown before payment. Extra pages are added to your subscription, raise the price of the following billing periods and apply, as shown in the app, to the magazines of the following issues. Sections 9 to 13 and the withdrawal information apply to extra pages accordingly.

15. Production and delivery

  • The magazine is printed and posted worldwide to the recipient's address; shipping is included in the price.
  • Production of an issue begins after its content is closed, that is after the end of the submission period and the editing period as shown in the app. Once production has begun, that issue can no longer be changed.
  • The time of delivery follows from the monthly issue cycle. Stated delivery times are non-binding estimates; they depend on printing, postal transit and customs and differ by country. No specific delivery date is agreed. Your statutory rights in case of late delivery remain unaffected.
  • You are responsible for the correctness, completeness and currency of the recipient's address. If delivery fails because of a wrong, incomplete or outdated address or because acceptance is refused, we re-ship the magazine on request against reimbursement of the resulting costs.
  • For shipments outside the European Union and Türkiye, customs duties, import charges and taxes may apply. Where they apply, they are borne by the recipient or by you. For shipments to Türkiye, the recipient does not pay customs duties or import charges.
  • As a consumer you bear the risk of accidental loss or deterioration only from the handover of the magazine to you or to a recipient designated by you (section 475(2) BGB). Towards traders the risk passes on handover to the carrier.
  • Colour and print quality may differ from the screen image depending on screen, paper and printing process; this is technical. Print quality depends on the resolution and quality of the photos uploaded: low-resolution photos that you use anyway may look blurry in print.
  • If a magazine is lost, damaged or defective, write to i116@pm.me and, if possible, send photos. Your statutory rights in case of defects and non-delivery are described in the Withdrawal information and are not restricted by these Terms.

16. Availability, backup and changes to the service

We aim for high availability but cannot promise uninterrupted operation: maintenance, outages at service providers or events beyond our control can cause interruptions. Postamory is not a backup or archive service. We back up data in the regular cycle of our service providers but do not guarantee permanent storage. So keep your original photos and texts yourself.

We may improve, change or discontinue features where this is reasonable for you. If we discontinue the entire service, we announce it with at least 30 days' notice and refund pro rata fees paid in advance for magazines that will no longer be delivered.

17. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent we have given a guarantee.

In case of slightly negligent breach of an essential contractual duty, that is a duty whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, our liability is limited to the typical damage foreseeable when the contract was concluded. For loss of data we are liable within this limit only to the extent the damage would not have occurred with regular backup of the originals appropriate to the risk. Otherwise our liability for slightly negligent breaches of duty is excluded.

These provisions also apply for the benefit of our legal representatives and vicarious agents. We are not responsible for content uploaded by members; section 6 remains unaffected. Mandatory statutory rights, including rights in case of defects and the mandatory consumer protection rules of your country of residence, remain unaffected.

18. Force majeure

Events beyond our reasonable control, such as natural events, war, pandemic, strikes, official measures, failures of power, networks or delivery services, or disruptions at service providers despite due care, release us for the duration of the disruption from the duties affected by it. If the disruption lasts longer than three months, either party may terminate the affected part of the contract; for services paid in advance and not performed we refund the fees pro rata.

19. Assignment and electronic communication

You may transfer rights and obligations under the contract to third parties only with our consent in text form; section 354a of the German Commercial Code (HGB) remains unaffected.

We communicate with you electronically. With the order you agree that we send confirmations, payment receipts, notices about payment, price and terms changes and cancellation confirmations by e-mail to the address of your account. You send notices to us at i116@pm.me; you can also declare cancellation and withdrawal through the functions provided for them.

20. Changes to these Terms

We may change these Terms for important reasons, for example changes in the law, in case law, in the service or in our service providers. Changes that materially shift the balance between performance and consideration or change our main performance duties require your express consent, which we will ask for.

We inform you of other changes at least 30 days before they take effect by e-mail or in the app and point out your right to object and the consequences. If you do not object within that period and keep using the service after the change takes effect, the new Terms apply. You can cancel until they take effect; the previous version then applies for the remaining term.

21. Final provisions

  • Severability: If a provision of these Terms is wholly or partly invalid or unenforceable, the rest of the contract remains valid. The statutory rule replaces the invalid provision (section 306 BGB).
  • Governing law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another state, the mandatory consumer protection rules of that state remain unaffected.
  • Jurisdiction: For consumers the statutory places of jurisdiction apply. If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction, where legally permitted, is the operator's seat stated in the Legal notice.
  • Language: The German version is authoritative. Translations are for understanding; in case of conflict the German version prevails, unless mandatory consumer law requires otherwise.
  • Consumer dispute resolution: We are not willing and not obliged to take part in dispute resolution proceedings before a consumer arbitration board. The former online dispute resolution platform of the European Union was discontinued in July 2025.
  • Contact: We answer questions about these Terms at i116@pm.me.
